Spanish regulator makes football rights appeal

The Spanish regulator CNMC has urged the Royal Spanish Football Federation (RFEF) to modify aspects of its proposals for the commercialisation of audiovisual rights for the Copa del Rey.

In a statement, CNMC says that on July 18 it reported on the RFEF’s proposals, which cover the Copa del Rey for the seasons 2019-22.

It adds that in a newly published report it urges the RFEF to adapt its proposal taking into account a number of factors.

These are:
Defining precisely the powers that have been granted and limit them to “the joint commercialisation of audiovisual rights included in the scope of Royal Decree-Law 5/2015.

Not including reservations of rights, non-exclusive rights, delimitation of the rights included in the lots, reserved rights, other rights, etc., which are not justified.

Not including commercial opportunities and obligations related to advertising that are not covered by the applicable legal norm.

Adjusting the minimum production standards set by the RFEF to its reasonable purpose, without exceeding it, particularly as regards the prior approval by the RFEF of the use and design of elements linked to such production.

Specifying issues that are insufficiently determined (mode of determining the production costs of the summaries or references taken for the determination of the acquisition price of the rights).
